1. Acceptance of Terms
By accessing or using FresnoSound ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use this Platform. These terms apply to all users, including gear renters, gear owners, musicians, and event organizers.
2. Platform Role & Disclaimer
FresnoSound is a marketplace platform that connects local musicians and gear owners. We do not own, inspect, store, or insure any gear listed on the platform. All transactions and agreements are strictly between the renter and the owner. FresnoSound is not a party to any rental agreement and is not liable for any disputes, damages, theft, or loss arising from any transaction.
3. Gear Rental Agreement & Liability
By submitting a rental request through this Platform, the Renter agrees to all of the following legally binding terms:
- Return in Original Condition: The Renter is obligated to return all rented gear in the same condition as received — including all accessories, cables, cases, and components. Normal, reasonable use is expected; damage beyond that is the Renter's responsibility.
- Liability for Damage or Loss: If any rented item is returned damaged, broken, missing components, or not returned at all, the Renter is fully financially liable for the cost of repair or full replacement at fair market value, as determined by the Owner.
- Right to Pursue Legal Action: If the Renter disputes a damage claim, refuses to pay, or fails to return gear, the Owner reserves the right to pursue legal action in a court of competent jurisdiction — including but not limited to filing in Small Claims Court in Fresno County, California — to recover damages, replacement costs, and any associated legal fees.
- No Platform Mediation: FresnoSound does not arbitrate disputes between renters and owners. The Renter acknowledges that their agreement is directly with the Owner, not with FresnoSound.
- Photo Documentation: Renters are strongly encouraged to photograph gear condition before and after the rental period. These photos may be submitted as evidence in any dispute.
- Governing Law: This rental agreement is governed by the laws of the State of California. Any legal proceedings shall take place in Fresno County, California.
4. Gear Owner Responsibilities
Gear owners are responsible for ensuring all listings are accurate, gear is in the condition described, and that they are the lawful owner of all listed items. Listing gear that is stolen, unsafe, or misrepresented is prohibited and may result in account termination and legal liability.
5. Musician Listings
Musicians listing on this platform represent that all information provided is accurate. Booking agreements are made directly between the musician and the client. FresnoSound is not responsible for cancellations, no-shows, or disputes arising from musician engagements.
6. Prohibited Uses
- Listing stolen, counterfeit, or illegally obtained goods
- Fraudulent listings or misrepresentation of gear condition
- Harassment or threatening behavior toward other users
- Using the platform for any illegal purpose
7. Account Termination
FresnoSound reserves the right to suspend or terminate any account that violates these terms, engages in fraudulent activity, or harms other users of the platform — with or without notice.
8. Changes to Terms
We may update these Terms & Conditions at any time. Continued use of the platform after changes are posted constitutes acceptance of the new terms.
